Modernized legislation reflects advances in artificial intelligence and automation As of 20 January 2027, the new Regulation (EU) 2023/1230 on machinery products will enter into force, replacing the existing Directive 2006/42/EC. This update reflects technological advancements, particularly in artificial intelligence (AI), digital connectivity, cybersecurity, and automated systems.

Unlike the directive, the new regulation will be directly applicable in all EU Member States, ensuring uniform implementation without the need for national transposition.

Key changes include:

  • Inclusion of software, AI, and machine learning systems as components that can affect safety.
  • Introduction of a “high-risk” machinery category, subject to stricter conformity assessment (e.g. AI-driven robots, collaborative machines).
  • Manufacturers will be required to ensure cybersecurity of control systems and prevent unauthorized access.
  • Option to provide technical documentation in digital form, reducing paperwork.
  • Clearer responsibilities for manufacturers, importers, and distributors, including those modifying or refurbishing machinery.

The regulation also addresses the demands of the digital environment, where machine-to-machine communication, remote software updates, and adaptive systems are increasingly common.

Manufacturers must reassess risk analyses, focus on AI algorithm safety, and ensure that software changes do not compromise safety.
